Terms of service

The agreement between you and us: what the service does, what you are responsible for, and who owns the data.

The agreement

These terms govern your use of Termind. By creating a workspace you accept them. If you are accepting on behalf of a company, you confirm you are authorised to bind it.

The service

Termind collects product and web analytics data you send us, computes metrics from it, and presents analysis of those metrics.

Metric values are computed deterministically in the database. AI-generated interpretation is presented alongside the evidence it used and is offered as analysis, not as advice or fact.

Your responsibilities

You are responsible for the lawfulness of the data you send us, including obtaining any consent required where your visitors are located, and for publishing a privacy notice that describes your use of analytics.

You must not send us payment card numbers, government identifiers, health records, or credentials. You must not use the service to track individuals across unrelated websites.

You are responsible for keeping your API keys secret and for activity performed with them.

Acceptable use

Do not attempt to access another customer's data, probe or load-test the service without written permission, resell the service without an agreement, or use it to build a directly competing product.

Availability

We aim for high availability but do not offer a contractual uptime guarantee on self-serve plans. We may change or discontinue features, and will give reasonable notice of material changes that reduce functionality.

Fees and billing

Account creation currently does not require a payment card. The application does not currently offer self-serve paid billing.

If paid plans are introduced, the price and applicable billing terms will be shown before purchase.

Ownership of data

You own the data you send us. We process it only to provide the service. We do not sell it, and we do not use one customer's data to train models for another.

You may contact us by email to request an export or deletion. After termination we retain data only as long as needed to complete the requested deletion and meet legal obligations.

Liability

The service is provided as is. To the fullest extent permitted by law our aggregate liability is limited to the fees you paid in the twelve months before the claim, and we are not liable for indirect or consequential loss, including lost profits or business decisions made using the analysis.

Nothing in these terms limits liability that cannot lawfully be limited.

Termination

You may contact us by email to request workspace closure. We may suspend or terminate an account that breaches these terms, and will give notice where it is lawful and practical to do so.

Changes

We may update these terms. Material changes will be communicated through the site, the application or email before they take effect where practical. Continued use after that date constitutes acceptance.
